Terms & Conditions

MyRecruit.App – Last updated: October 2026

1. Scope and contracting parties

These Terms apply to customers of SteinmetzPartners – Executive Consultants GmbH (Provider) using MyRecruit.App. The service is offered exclusively to businesses within section 14 German Civil Code and comparable legal entities. The registering person confirms authority to act for the stated organization.

2. Services and contract documents

The Provider supplies MyRecruit.App as web-based software. The free account includes the functions and allowances shown for that account. Use beyond those allowances is governed by an individual SaaS Agreement, service description and Service Level Agreement (SLA).

In case of conflict, the individual SaaS Agreement, SLA, Data Processing Agreement (DPA) and its annexes, and these Terms apply in that order. The Provider does not provide legal or tax advice; the Customer remains responsible for accounting, tax and retention duties.

3. Registration and free account

  • After registration and activation, an organization may use the stated business-plan functions free of charge without a fixed expiry date.
  • The free MyRecruit.App account may store up to 100 candidates at the same time. Positions and applications are not limited separately.
  • Each organization may create up to five new orders per calendar year in the free account.
  • Free document storage is limited to a total of 1 GB per organization, including stored document versions and attachments. Mandatory records generated automatically for a business transaction started within the free limits continue to be generated and archived.
  • Reaching a free limit does not trigger automatic charges. Use beyond that limit requires an expressly concluded individual SaaS Agreement.
  • No SLA applies to the free account; support is subject to availability.

Free-account users may use the self-service exports available in the application. The free account does not include an individually prepared handover or migration package; mandatory statutory rights and the DPA return or deletion duties remain unaffected. When the free account ends, productive data is deleted within 30 days unless a subsequent agreement or legal retention duty applies; backups are overwritten under the established deletion cycles.

4. Paid use, fees and term

Use beyond the free allowances requires an individual SaaS Agreement defining modules, users, storage, AI or other allowances, fees, billing, term and termination. Without it there is no automatic renewal or payment obligation.

Unless agreed otherwise, invoices are due within 14 days. For material payment default, the Provider may suspend access after a reminder and reasonable cure period.

5. SLA, maintenance and support

Binding availability, measurement, maintenance windows, response and restoration times, support channels and service credits are governed exclusively by the individual SLA. Without an SLA, no specific percentage availability is owed.

6. Data migration and additional services

Legacy migration, cleansing, mapping, customizations, training and consulting are outside the free account and standard SaaS scope. They require a separate agreement covering format, scope, cooperation, testing, acceptance, schedule and fees. The Customer remains responsible for the lawfulness, quality and completeness of supplied data.

7. Customer obligations

The Customer processes only lawfully obtained data, manages users and permissions, protects credentials, keeps devices current and avoids abusive or security-threatening use. The Customer reviews generated content, analyses and AI output before use and exports data required for its retention and backup duties.

8. Data protection and confidentiality

The Privacy Policy covers the Provider's own account and contract data. Where personal data is processed for the Customer, the DPA, TOM and sub-processor list apply from the start of free use. Both parties protect the other party's confidential information.

9. Defects and liability

The Provider has unlimited liability for intent, gross negligence, injury to life, body or health and mandatory statutory liability. For slight negligence concerning an essential contractual duty, liability is limited to typical, foreseeable loss; other liability for slight negligence is excluded.

To the extent permitted, strict liability under section 536a(1) German Civil Code is excluded.

10. End of contract and return of data

For Customers with an individual SaaS Agreement, that agreement governs term and termination. Unless a longer period is agreed, the Provider may ordinarily terminate an indefinite agreement on three months' notice to the end of a calendar month; a fixed minimum term remains unaffected. If the Provider intends to discontinue all or a material part of the service, it will notify the administrative contact in text form and in the application at least three months in advance. Termination for cause remains available to both parties.

The agreed functions will generally remain available until contract end. The Customer may initiate a switch to another provider or on-premises infrastructure with no more than two months' notice. The Provider supports the switch within mandatory statutory transition periods.

Customers with a SaaS Agreement receive a secure, tenant-specific export covering exportable data entered by or generated directly for them in a commonly used, structured and machine-readable format. It includes UTF-8 CSV files for structured data, existing documents and attachments in their file formats, required identifiers and a description of the export structure. Internal system and security data and Provider trade secrets may be excluded only where this does not prevent or unreasonably impede switching.

The standard export and operations necessary for switching are supplied without a switching charge to the extent required by law. Where still legally permitted, charges are limited to direct switching costs disclosed transparently before contract formation. Separately requested services such as bespoke formats, cleansing, mapping, consulting or implementation support for a third-party system may be charged separately.

The export remains retrievable for at least 30 calendar days after the transition period. Productive Customer Data is then deleted unless law or a longer agreement requires retention. Backups are overwritten under documented cycles and until then used only for recovery and security. The Customer remains responsible for continued storage and statutory retention.

11. Final provisions

German law applies, excluding the UN Sales Convention. Where permitted, Frankfurt am Main is the exclusive place of jurisdiction. Individual amendments require at least text form unless stricter form is agreed.
